JUDGMENT 1. - Heard the learned counsel for the petitioner and the learned Public Prosecutor for the State and also perused the relevant record/case diary as also the statement of injured-Bholi, who sustained right frontal depressed fracture with pneumocephalus and a linear fracture. As per his statement co-accused Chatru and Ram Khiladi inflicted lathi and gandasi blows on his head. He has not assigned any injury to the petitioner. A cross-case by the petitioner-party was registered on 5.3.1996, wherein after investigation a challan for the offences Under Section 148 & 302 Indian Penal Code has been filed by the police against the complainant party. In this case the FIR was also lodged after eight days i.e. on 13.3.1996.Taking a conspectus of the entire facts and circumstances of this case, it is just and proper to grant anticipatory bail to the petitioner(s) Under Section 438, Criminal Procedure Code.The SHO/Arresting Officer/Investigating Officer, Police Station Bhusawar District Bharatpur is directed that in the event of the arrest of petitioner(s) Mangati, (2) Ram Kishor, (3) Paras Ram & (4) Ram Singh in crime No. 91/1996 of aforesaid Police Station they shall be released on bail, provided each of them furnishes a personal bond in the sum of Rs. 10,000/- (Rs. ten thousand) with two sureties in the sum of Rs. 5,000/- each to the satisfaction of the S.H.O. concerned on the following conditions : 1. that the petitioner(s) shall make themselves available for interrogation by a Police Officer as and when required. 2. that the petitioner(s) shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, so as to dissuade him from disclosing such facts to the Court, or any Police Officer, and; 3. that the petitioner(s) shall not leave India without previous of the Court.
