JUDGMENT : I.A. No. 18 Hindu Rao Hospital: 1. Pursuant to this Court's order dated February 22,1996, Mr. Krishan Mahajan and Mr. J.K. Mathur have filed an interim report. Mr. Jain has also filed a separate note. We have examined both the reports. It would be useful to have a look at our order dated February 22, 1996: "We have examined the report submitted by the Mahajan Committee. We are of the view that some more exercise has to be done in the matter. We, therefore, request Mr. Mahajan, Mr. Mathur and Mr. P.C. Jain to have the area inspected once again. We request Mr. Nag, the Senior Architech and Mr. Bagga, the Town Planner to accompany the team. Mr. Mahajan will inform the other members of the Committee of the date and time when the inspection is to be done. We make it clear that we want the assistance of the Committee in identifying the minimum area which is necessary for the operation of the Hospital. The location of major buildings at various places may also be indicated. The total plan of the area indicating the building and other constructions should be indicated. The Senior Architech of the M.C.D. with the assistance of the Town Planner shall make a Scale Plan. The purpose of the inspection is to leave only the bare minimum area with the hospital and take over the remaining areas to be added back to the Ridge." 2. Mr. Mahajan in para 6 of his report has stated that the area measuring 7.841 acres can be retrieved from the total area under the possession of the Hindu Rao Hospital and can be restored to the Ridge. Para 6 of the report is as under : "6. From the site inspection and the amended map it is found that the following are the areas which can be added to the Ridge: (i) Area abutting Northern Boundary of the Hospital. = 4.840 acres (ii) Area North-east of Hospital under Dalao on Ridge Road = 0.474 acres (iii) Area on the South West side Marked B on he Plan (excluding essential staff quarters of D.W.S. & S.D.U.). = 1.470 acres (iv) Area on the Malkaganj road side entry of the Hospital. = 1.057 acres Total = 7.841 acres 3. We agree with the suggestion in para quoted above.

We, therefore, order that the above 7.841 acres of area shall be taken away from the Hospital authorities/M.C.D. and be restorated to the Ridge. Any order on the basis of which the above-mentioned area was added/alloted to the Hospital shall stand cancelled and be nonest. We direct the Ridge Management Board through Mr. D.C. Khanduri to take over the control of this area and merge the same with the Ridge in the best possible manner and dhave the same fenced. This shall be done within two weeks of the receipt of the order by the Management Board. 4. So far as further expansion of the Hospital is concerned, needless to say that Hospital can add more accommodation if they so need on the existing area in accordance with the rules or by acquiring land out of "Ridge" area. 5. It is also mentioned in the report that there are unauthorised encroachments in the above-mentioned 7.841 acres of area. We direct the Municipal Corporation of Delhi through its Commissioner to have the unauthorised encroachments removed within the period of four weeks from today. We, however, give liberty to the Commissioner to have further directions from this Court, if necessary. 6. Para 9 of the report refers to two shops which are operating under the authority of the M.C.D. We make it clear that M.C.D. has no authority to permit any shop keepers to operate within the Ridge area. The M.C.D. shall have the shops shifted from the Ridge area by following the procedure in accordance with law. 7. Para 10 of the report states that a road within the Hospital has been permitted to be used as a public road passing through the Hospital to Malkaganj. It is stated that this thoroughfare is not only detrimental to hospital security but is also against the general character of the Ridge. Mr. Bagga, Town Planner is present in Court. We request Mr. Bagga to examine the matter and place before this Court his response regarding closing the road to public. This may be done within two weeks. I.A. No. 22 8. Mr. Gopal Subramaniam, learned counsel appearing for the State'of Haryana, has very fairly states (sic) that the State of Haryana is willing to provide two additional bore wells to the stone crushers. He states that the stone crushers would have to pay Rs. 25 lacs as the construction cost of the two bore wells. It is further stated by Mr. Subramaniam that a feeder line to supply electricity to the stone crushers has already been installed and shall be shortly commissioned. So far as the roads are concerned, Mr. Subramaniam agrees that the conditions of roads is very bad. In fact the roads do not exist in the area. Mr. Subramaniam states that the work of constructing the road shall be undertaken immediately and substantial work shall be done by 30th June, 1996 and the construction of the roads shall be complete by December 30, 1996. 10. Mr. R.K. Anand, learned counsel appearing for the stone crushers, states that he would consult his clients as to whether they would have the work of bore wells done through the Haryana Government or by a private agency on their own. 11. Mr. Gopal Subramanaiam states that the mining work has stopped within the radius of 5 kms. of Badkhal Lake and Suraj Kund. We appreciate the gesture of Haryana Government. Mr. Subramaniam states that the steps to provide green belt in that area are also in progress. He shall place on record the positive steps which are in the contemplation. 12.
