JUDGMENT : OFFICE REPORT ITEM A 1. Mr. Kaushal, learned counsel appearing for the Delhi Pollution Control Committee states that further extension for 3-4 weeks be given to comply with this Court's order dated August 25, 1995 read with September 22, 1995. As a last opportunity, we give four weeks time to the Committee to comply with our orders. Mr. Kaushal says that the Committee is short of staff. We request the Chief Secretary, Delhi Administration to consider the request of the Committee for more staff so that they can cope with the work assigned by this Court to the Committee. ITEM B 2. Pursuant to this Court's order dated November 15, 1995 and December 6, 1995 the Central Pollution Control Board has filed its report. The learned counsel appearing for the Industries state that they would like to inspect the report in the Registry so that they are in a position to assist this Court. They may do so. We give two weeks time to the learned counsel to have the necessary inspection done in the Registry. We direct the Registry to permit the inspection of the report to the learned counsel. 3. Mr. Panjwani has on our request given a copy of the report to Mr. JB Dadachanji for the benefit of all the learned counsel for the Industries. 4. List on 24th January, 1996. ITEM C 5. Pursuant to this Court's order dated September 14, November 21 and December 13, 1995 Mr. Panjwani states that the Central Pollution Control Board is in the process of considering the objections filed by various Industries. He needs further two weeks time to complete the exercise. He may do so. 6. List on 7th February, 1996. ITEM D 7. We direct the Central Pollution Control Board in association with the Delhi Pollution Committee to send an inspection team to Industries, listed from SI. Nos. 77 to 227 and the 31 Industries, listed in the affidavit of the Committee and file a status report in this Court within three weeks. The report shall indicate as to whether these Industries have installed/started the construction work regarding the necessary Pollution Control Devices required in their respective Industries. 8. Their Industries be opened after the fine is deposited. 10. The learned counsel for M/s. Rodo Footwear states that the Industry which is operating under the three Units in the same area have been closed for future. 11. On September 22, 1995 we passed the following order: "It is of utmost importance that CETPs should be constructed in all the above- mentioned areas as early as possible. This is the function of the Delhi Administration under the charge of the Development Minister. We direct the Development Minister, Chief Secretary, Secretary Environment, Secretary-Industries, Commissioner-MCD and Vice-Chairman- DDA to take a positive action towards controlling the pollution in the above mentioned Industrial Areas. We are of the view that the construction of ETPs in the above-mentioned Industrial Areas must start expeditiously and preferably within the next four months without indicating any further, we leave it to the authorities mentioned above to frame their own plan of action in this respect and inform this Court about the action taken in this respect by filing an affidavit of a responsible officer within four weeks from today.....". 12. The above quoted order was passed in connection with the setting up of the common effluent treatment plants for cluster of Industries operating in different parts of Delhi. None of the authorities mentioned in the above-quoted order, have filed any report either in the shape of an affidavit or otherwise to show as to what progress has been made in the construction of combined effluent treatment plants in 28 Industrial areas in Delhi/New Delhi. Before we take any action in this respect we once again request Mr. Sahib Singh Verma, Development Minister, Mr. PP Chauhan, Chief Secretary, Mr. DS Negi, Secretary - Environment, Mr. Virender Singh, Secretary Industries (all of NCT Delhi), Mr. Subhash Sharma, Commissioner, MCD and Mr. Anil Kumar, Vice Chairman, DDA to have the compliance of this Court's order dated September 22, 1995. We give further four weeks time from today to these authorities to comply with our order.
PP Chauhan, Chief Secretary, Mr. DS Negi, Secretary - Environment, Mr. Virender Singh, Secretary Industries (all of NCT Delhi), Mr. Subhash Sharma, Commissioner, MCD and Mr. Anil Kumar, Vice Chairman, DDA to have the compliance of this Court's order dated September 22, 1995. We give further four weeks time from today to these authorities to comply with our order. We reiterate that common effluent treatment plant shall have to be constructed in the 28 Industrial Estates to control pollution. The common plants cannot be constructed without the efforts and initiative of the above mentioned authorities. The affidavit of a responsible officer on behalf of each of those authorities shall be filed in this Court before 14th February, 1996. Copy of this order be sent to all these authorities by name by the Registry. 13. We. have requested Mr. Swaraj Kaushal, learned senior counsel appearing for the NCT, Delhi to have a personal talk with Mr. Sahib Singh Verma, Minister In- charge to expedite the setting of the common/combined effluent treatment plants. 14. List on 14th February, 1996. ITEM E 15. Mr. Arun Jaitley, learned senior counsel appearing for the DDA states that the report pursuant to this Court's order dated November 24, 1995, November 30, 1995 and December 13, 1995 is ready. He further states that the report is prepared after taking into consideration the suggestions given by the representatives of the Industries. It would be useful to give one or two copies of the report to the learned counsel so that they can apply their mind to the report. 16. List on 17th January, 1996. ITEM F Anand Parbat Area 17. Mr. PC Jain, Additional Commissioner, DDA states that Anand Parbat Area as at present is unauthorised/unregularised. He, however, states that there is a proposal before the DDA to regularise the Anand Parbat Area as an Industrial Area. According to him in case the area is regularised only light Industries categorised under the Master Plan 2001 as A-E would be permitted in the area. He states that so far as hazardous/noxious Industries are concerned, they shall have to be relocated. 18. We direct the Delhi Pollution Control Committee to prepare a list of hazardous/noxious Industries in the Anand Parbat Area (F, G, H-1 and H-2) and issue notices to these Industries indicating that these Industries shall relocate themselves from this area.
He states that so far as hazardous/noxious Industries are concerned, they shall have to be relocated. 18. We direct the Delhi Pollution Control Committee to prepare a list of hazardous/noxious Industries in the Anand Parbat Area (F, G, H-1 and H-2) and issue notices to these Industries indicating that these Industries shall relocate themselves from this area. The list shall be filed in this Court within three weeks from today. 19. So far as the construction of common effluent treatment plant is concerned, in a separate order today we have requested Mr. Sahib Singh Verma, Development-cum Environment Minister, NCT, Delhi Administration to consider for setting up of the common effluent treatment plant in various industrial areas. He may look into the Anand Parbat Industrial Area also. Mr. DD Thakur, appearing for the Industries in the Anand Parbat Area on the last hearing had indicated that the Industries are willing to contribute their share for construction of the common effluent treatment plan. Minister in-charge is well advised to take up the matter of setting up of the common effluent treatment plant at war footing. 20. List on 14th February, 1996. 21. We request Mr. Arun Jaitley to personally take up the matter with Mr. Anil Kumar, Vice Chairman of the DDA. We are informed that Mr. PC Jain is due to retire soon. Mr. Jain has been assisting this Court in the setting up of the sewage treatment plants, relocation of the Industries and various other aspects undertaken by this Court in the environment and pollution control matters. If it is possible, he may be permitted to continue on some assignment till the end of this year. We request Mr. Arun Jaitley to take up the matter personally with the Vice Chairman, DDA.
