Judgment S. J. Mukhopadhaya, J. 1. The petitioners have filed this writ petition for direction on the respondents to include the names of the petitioners in the district Panel to be prepared by the district Magistrate, Katihar for regular appointment against Class-IV posts, which are laying vacant in different Muffasil offices of the State Government,including the Muffasil office of Health department of the State of Bihar in the said district. 2. The petitioners are seasonal employees under the Respondents State of Bihar in its Health Department, who are performing the duties of D. D. T workers. The Respondents are taking work from the petitioners for such d. D. T spraying work for different months in a year, on seasonal basis. It will be evident from paragraph-4 of the writ petition that such duties are being performed by the petitioners since 1982-92. It is alleged that the panel which is to be prepared by the District magistrate for regular appointment against Class-IV posts, in different muffasil Offices of the State Government, including the offices under the Health department, therein the names of the petitioners have not been included, though they are performing duties as seasonal workers since last 4 to 14 years. 3. It is stated that the Commis-sioner-cum-Secretary of the Health department, vide their letter dated 27th December, 1991 has requested all the District Magistrates and Deputy commissioners to include the names of the seasonal D. D. T workers who are working in the Health Department of the Government of Bihar, in the panel for their regular appointment against class-IV posts, but such action has not yet been taken. 4. A counter affidavit has been filed on behalf of the Collector, Katihar. However, this court is not satisfied with the said counter affidavit, as the same has not been happily drafted, particularly, paragraph-15 therein. 5. Counsel for the State submits that panel is to be prepared on the basis of a circular dated 3rd December, 1980. It is further stated that the names of the petitoners and other D. D. T. workers have been received in the office of the district Magistrate, Katihar, recently. It is stated that the names of the petitioners will be included in the panel which will be prepared in future. 6.

Having heard the parties, this court directs the Collector, Katihar to include the names of the petitioners in the panel for appointment against class-IV posts in different Muffasil offices of the State Government in the district of Katihar. If any of the petitioner (s) have become over-age, in the meantime, for regular appointment against Class-IV posts, in their cases, age is to be relaxed. They will include the names of the petitioners, taking into note the circular of the State Government dated 3rd December, 1980, as well as the direction of the Health commissioner-cum-Secretary dated 27th december, 1991. The petitioners and other D. D. T workers, they should be given preference over outsiders, for the purpose of placing their position in the panel. The class-IV posts which are laying vacant in different Muffasil offices of the State of Bihar in the district of Katihar, including Muffasil offices of the Health Department of the said district are to be filled up out of this panel in terms of Circular dated 3rd december, 1980. The panel is to be finalised within three months from the date of receipt/production of a copy of this order. The writ-petition stands disposed of with the aforementioned observations and directions.
