JUDGMENT 1. - Instant writ petition has been filed by the petitioner seeking a relief that the land acquisition proceedings with respect to Khasra Nos. 728, 733, 729, 731, 732, 734 and 737 situated in village Vasara Tehsil, Abu Road, District Sirohi pending before the respondent No. 2 may be dropped and the notification issued under section 4 of the Land Acquisition Act with reference to the aforesaid khasras be quashed. 2. I have heard the learned counsel for the parties at length. 3. Indisputably the land in dispute was being acquired by the State Government for the benefit of respondent No. 4, the Rajasthan State Industries Development and Investment Corporation Ltd. A close scrutiny of the paragraph 4 of the reply filed on behalf of respondent No. 4 throws a flood of light that the respondent No. 4 have already indicated to the State that the land in dispute may be dealt with under section 48 of the Land Acquisition Act and the answering respondent specifically made clear that the land is not required by the answering respondent as according to respondent No. 4 it is not suitable for their industrial purposes. 4. The controversy involved in the instant writ petition is squarely covered by a decision taken by learned Single Judge of this Court in the case of M/s. Western Indian State Motors Ltd. v. State of Raj. & Anr., SBCWP No. 3450 of 1993 decided on 7.5.1996 . The present controversy again came up for consideration before another learned Single Judge of this Court in the case of Deshot Kanwar Bhati v. State of Raj. decided on 18.7.1996. In these cases proceedings before Land Acquisition Officers have been dropped. 5. I respectfully concur with the ratio of the case of M/s. Western Indian State Motors Ltd. (supra) as well as the ratio of the case of Deshot Kanwar Bhati (supra). In my considered opinion the present controversy is squarely covered with the aforesaid two decisions of this Court. 6. Consequently, the instant writ petition is allowed and the respondents are directed to delete Khasra Nos. 728, 733, 729, 731, 732, 734 and 737 situated in village . Vasara, Tehsil Abu Road, District Sirohi from the acquisition and withdraw from the acquisition of the a esaid Khasras number of which admittedly possession has not been taken. 7. Both parties are directed to bear their own costs.Writ allowed .
