JUDGMENT 1. - Heard learned counsel for the petitioner and learned Public Prosecutor for the State and also perused the documents on record. 2. Mr. Balwada submits that in second bail application the liberty was given to petitioner to move fresh bail application after the statements of Islamuddin, Shabbir Hussain and Jamir Mohammad. All these witnesses are examined and they declared hostile. There is no direct allegation against the petitioner in the statements of PW 4 Ram Singh and PW 5 Surendra Kumar. The petitioner is in custody for last 8 months. 3. These facts have not been controverted by learned P.P. 4. In the facts and circumstances of the case and the arguments advanced by both the sides, I am inclined to grant bail under Section 439 Criminal Procedure Code to the accused petitioner. 5. It is, therefore, ordered that the accused petitioner Ilias s/o Hameed shall be released on bail provided he furnishes a personal bond in the sum of Rs. 30,000/-(Rupees thirty thousand) with two sureties in the amount of Rs. 15,000/- each, to the satisfaction of trial Court with the stiputation to appeal in that Court as and when called upon to do so during the pendency of trial against him in this case.Bail Allowed. *******
