JUDGMENT : 1. SLP (CRL) NO. 4421/95 : The interim order made in W.P. (C) No. 640/95 restraining the respondent - Shri Chandra Swamy from leaving India and proceeding to any other foreign country shall continue until further orders as an order made in this S.L.P. 2. The S.L.P. be listed for hearing immediately after the disposal of W.P. (C) No. 640/95 unless directed to be listed it earlier. 3. W.P. (C) No. 640/95: In view of S.L.P. (Crl) No. 4421/95 filed by the C.B.I. against Shri Chandra Swamy, the relief claimed initially in this Writ Petition to restrain Shri Chandra Swamy from leaving India and going abroad is no longer necessary in this Writ Petition for which reason such a prayer is not included in the reliefs claimed in the amended Writ Petition. That matter is to be considered separately in the S.L.P. filed by the C.B.I. 4. In view of the above fact, the presence of respondent No. 3 - Shri Chandra Swamy as a party to this Writ Petition is unnecessary since the scope of this Writ Petition relates only to the performance of its duty by the several Government agencies and no relief as such is claimed in this Writ Petition against Shri Chandra Swamy himself. The petitioner is, therefore, permitted to delete the name of Shri Chandra Swamy from the array of respondents. Shri A.K. Sen, learned counsel for respondent No. 3 has no objection. 5. Learned S.G. as well as Shri Anil Diwan, learned counsel, are heard. The Secretary, Revenue - Shri Sivaraman, the C.B.I. Director - Shri K. Vijay Rama Rao and the Commissioner of Delhi Police - Shri Nikhil Kumar are also present. We direct that from now each of these three officers would be overall incharge of the investigations which are being carried on by their respective departments pertaining to the matters within the scope of this Writ Petition. Learned S.G. on instructions prayed for deferring the further hearing to enable the above officers to report the progress made in the investigations by these agencies on the next date. 6. List the matter on 12.4.96 at 2.00 p.m.
