JUDGMENT : Part-heard from 19.3.1996 1. Shri Sanjay Parikh has filed his written submissions and an affidavit. The same may be taken on record. Judgement reserved. Item 'C' 2. Pursuant to this Court's order dated March 13, affidavit dated April 4,1996 has been filed by Mr. V. Venugopal, Deputy Secretary in the Ministry of Power, New Delhi. Mr. A.K. Vashishta, Chairman of the Board has also filed affidavit. We have been taken through both the affidavits. The affidavits are of no help to us. Mr. Arun Jaitely, learned counsel appearing for the U.P. State Electricity Board states that the Chief Engineer, in consultation with other officers of the Board, shall file an additional affidavit stating therein the time-schedule and the target date by which the Board shall be in a position to supply uninterrupted power supply within the Tax Trapezium. This may be done before April 10, 1996. 3. Mr. B.B. Singh and Mr. Surinder Singh, Chief Engineers of the U.P. State Electricity Board are present in Court. We have personally made them understand what they have to do and in what manner they have to file the affidavit before the Court. List the matter on April 10, 1996. Item 'D' 4. Pursuant to this Court's order dated March 14, 1996, the Brick Kiln owners are before us. We have heard learned counsel for the Brick Kiln owners. It is suggested by learned counsel that Taj Trapezium being huge area, the brick kilns may be confined to the farthest end of the Trapezium or in any case to the area from where the emissions cannot affect Taj Mahal. It is further suggested that a report from an expert body may be obtained in this respect. We request Dr. P. Khanna, Director, NEERI to send an inspection team to visit the brick kilns in Taj Trapezium and report whether it will be permissible-keeping in view the environmental and Taj preservation to permit (he brick kilns to operate in the Taj Trapezium at a safe distance from the Taj. The report be sent to this Court within two weeks. Needless to say that the expense of the NEERI inspection team shall be paid by the Brick Kiln owners. Meanwhile, we direct the U.P. State Industrial Development Corporation to suggest some suitable areas outside the Taj Trapezium where the brick kilns can be re- located if it is to be done finally.

This order be sent by fax to Dr. Khanna. Item 'E' 5. Pursuant to this Court's order dated 15, 1996, Mr. V.N. Rao, Regional Director, National Dairy Development Board, New Delhi has filed affidavit. It is stated in pare 4 of the affidavit that on March 26, 1996, the National Dairy Development Board has agreed to provide technical consultancy to the Department of Animal Husbandry, Government of India, for the proposed slaughter house at Agra. 6. In para 6 of the affidavit, the time- schedule for the completion of the slaughter house has been given. The total time- schedule runs over a period of 33 months prepared in a rather lazed manner. We suggest the following time-schedule for the consideration of the Regional Director. (a) Section and appointment of Consultants and other formalities. : One week. (b) Preparation of design, drawings, cost estimates and evaluation. : Six weeks. (c) Preparation of tender bids : Five weeks (d) Time for inviting tender bids : Four weeks (e) Evaluation and selection of tender & negotiations, if required. : Eight weeks (f) Placement of work tender : Two weeks (g) Execution of civil and mechanical works : Sixty weeks (h) Post completion inspection trial runs : Four weeks. 7. Though the above mentioned time- schedule is in the nature of a suggestion. We have no doubt that it would be adhered to by the National Dairy Development Board. We direct the Regional Director of the Board to simultaneously start working on various aspects involved in the project. The Board to file affidavit indicating the progress mad in the project. We request the Ministry of Animal Husbandry, to fully co-operate with the Board. Copy of this Order be sent to the Regional Director of the Board, within two days. Item 'F' 8. Kishore, Joint Secretary, Urban Development Department, U.P. has filed affidavit indicating the progress regarding "Gokul Barrage" and "Agra Barrage". It is stated that the delay in the construction of Gokhul barrage is due to non- availability of funds.
Item 'F' 8. Pursuant to this Court's order dated March 13, 1996, Mr. N. Kishore, Joint Secretary, Urban Development Department, U.P. has filed affidavit indicating the progress regarding "Gokul Barrage" and "Agra Barrage". It is stated that the delay in the construction of Gokhul barrage is due to non- availability of funds. It is stated that the Agra barrage project is also getting delayed due to paucity of funds. The requirement of funds for this Project are indicated as follows: Rs.(In crores) 1. Remaining works of Gokul Barrage 12.50 2. Water Supply works of Gokul Barrage 42.00 3. Remaining parts of connecting roads of Gokul Barrage. 2.76 4. Agra Barrage works 100.00 5. Water supply works of Agra Barrage Project. 80.00 Total 237.26 9. It is stated that fifty per cent of the cost, i.e. 118.63 crores is to be contributed by the Government of India. We direct the Secretary, Water Resources Ministry and the Director, Central Water Commission, to give their response regarding the contribution of half of the project costs by the Government of India. It may be indicated as to whether the necessary funds can be made available to the State of U.P. for the above mentioned two projects, and if so, within what time. Copy of this order be sent to the Ministry within two days. 10. List the matter on April 10, 1996.
