JUDGMENT : 1. We have perused the report of the CBI made in pursuance of the order of this Court in the writ petition. The view of the CBI as stated in the report is that a prima facie case of criminal conspiracy and murder is made out against the 17 police personnel mentioned therein namely, Inspector Swaran Singh, SI Balbir Singh, ASI Daljit Singh, HC Mukhtiar Singh, HC Sawinder Singh, LC Sulakhan Singh, LC Amarjit Singh, Const. Nirmal Singh, SPO Hardeep Singh, SPO Sukhwinder Singh, Inspector Bishamber Singh, SI Tilak Raj, HC Gurdarshan Singh, LC Dalip Kumar, Const. Gurdawar Singh, Cont. Sukhwinder Singh and Const. Sunil Dutt. It has also been stated in the report that Inspector Swaran Singh is also liable to be prosecuted for giving false information to screen the accused. 2. In view of the above report, we direct the State Govt. to take the necessary steps to prosecute the aforesaid 17 police personnel for the offences alleged to have been committed by them. 3. Two copies of the report submitted by the CBI in this writ petition shall be retained in a sealed cover as a part of the record of this case. One copy of the report be given to Mr. R.S. Suri, learned counsel appearing for the State Govt. to enable the State Govt. to proceed in the manner directed to prosecute the said police personnel. The State Govt. is also directed to take the necessary steps to provide protection to the witnesses who have deposed in the enquiry conducted by the CBI as mentioned in the report as well as the petitioner and the parents of the deceased Gurmeet Singh. 4. We also direct that in addition to the sum of Rs. 50,000/- already paid to the petitioner towards compensation, a further sum of Rs. 1,50,000/- or in all, a sum of Rs. 2,00,000/- be paid by the State Govt. to the petitioner as compensation for herself and the parents of the deceased. The payment is to be made by depositing the amount in this Court within four weeks and the Registrar General would ensure the payment of that amount to the petitioner through the Bank.

This amount would be liable for adjustment in the amount finally determined to be payable as compensation to the petitioner and the parents of the deceased Gurmeet Singh in any other proceedings taken by them for recovery of compensation on the same basis. We clarify that no part of this amount of Rs. 2,00,000/- would be refundable in any event to the State Govt. by the petitioner or the parents of the deceased. 5. We make it further clear that the State Govt. would be entitled to proceed against the delinquent officers including the police personnel responsible for the killing of Gurmeet Singh and to also recover the amount of compensation paid by the State Govt. from them, in an appropriate proceedings on the basis of the liability imposed on those persons. 6. The writ petition is disposed of.
