Honble JAIN, J. – This revision petition has been filed against the order dated 18.3.1996 of the learned Addl. Distt. Judge No. 1, Jodhpur in Civil Original Suit No. 146/94 whereby the learned Addl. Distt. Judge did not grant any further adjournments to the plaintiff-petitioner to make up the deficiency in stamp and deposit the penalty in pursuance of the order of the Court dated 10.1.1996. (2). I have heard learned counsel for the petitioner as well as the non-petitioner and perused the impugned order. It is correct that the learned Addl. Distt. Judge has given ample latitude to the plaintiff-petitioner to comply with the order dated 10.1.1996, but in the interest of justice, I deem it proper to give one last opportunity to the plaintiff petitioner to produce the stamps and deposit the penalty of Rs. 24,900/- within one month from today on the condition that he pays a sum of Rs. 1,000/- as costs to the defendant-non-petitioner. (3). The order of the learned Addl. Distt. Judge is quashed and the revision petition is disposed of accordingly.
