JUDGMENT 1. - In this petition, the grievance of the petitioner is three fold which relate to non-payment of medical bills of October, 1995, non-payment of annual grade increments from September, 1995, non-payment of salary of June and November, 1995. He is also claiming revised pay scale as per rules. Before filing the writ petition, a notice for demand of justice was given to be concerned Managing Director, and the General Manager but it appears that the claim of the petitioner was not considered as he has received no communication or decision from them. It is regrettable that Public functionaries act in such a manner. The very object of giving a notice for demand of justice is to consider the claim of the aggrieved person and if he is found entitled to get the relief, then, to grant the same in order to check unnecessary and un-wanted litigation in a court of law. Most of the cases are filed in the High Court by way of writ petition due to in-action on the part of the State functionaries and such petitions could be avoided if the matters are decided in time by the concerned authorities. It is high time for the public functionaries to realise their accountability not only to the people but to the Courts also and they should not be party in increasing cases and in-flow of cases in the Courts for their inaction in taking not taking decisions in time. 2. Be that as it may, taking into consideration all the facts and circumstances of the case, the petition is being disposed of in the following terms : 1. That the petitioner shall make a fresh representation alongwith a copy of this order within two weeks from today to the concerned Managing Director and General Manager detailing out all his grievances and the reliefs he claims. 2. The said representation shall be decided by a speaking order by the concerned authority in next three months and the petitioner shall be given all such reliefs for which he is found to be entitled. The petitioner shall also be intimated about the decision immediately. Afterwards, if the petitioner feels aggrieved against the said order, he shall be free to challenge the same in accordance with law. 3. It is made clear that in case the representation of the petitioner is not decided within the stipulated time, it shall be seriously viewed by this Court and necessary action may be taken against the defaulting officer. 3. A copy of this order be also sent to the Secretary, Govt. of Rajasthan, Department of Cooperative, Jaipur for necessary compliance and action.Petition disposed as per above view. *******
