Judgment N. Pandey, J. 1. Heard learned counsel for the petitioner and the State. 2. This petition (LA.435 of 1997)has been filed for staying the order contained in Annexure 1 dated 3-1-1997 whereby the petitioner was suspended on the ground that he was detained in custody. 3. Learned Counsel for the petitioner contended that the ground for suspension is non est since the petitioner was already released on bail by virtue of an order of this Court dated 16-12-19% passed in Cr. Misc. No.5417 of 1996. 4. There is no dispute that the impugned order of suspension has been passed merely on the ground that the petitioner was detained in custody. This goes without saying, if the petitioner has already been released, the respondent authority will have to recall the order of suspension. 5. Accordingly, I direct the Deputy development Commissioner (Respondent No.2) to recall the order of suspension since the petitioner has already been released on bail. 6. With the aforesaid, the main writ petition itself is disposed of.
