JUDGMENT 1. - Heard at admission stage. 2. The accused petitioner was convicted for offence under Section 354 IPC and sentenced to two months SI and a fine of Rs. 2,000/- by the learned Judicial Magistrate, Sadul Sahar on 21.7.94. It was further ordered that in case he does not pay the fine, he would undergo simple imprisonment for two months. He preferred an appeal before the learned Sessions Judge, Ganganagar which was ultimately decided by Additional Sessions Judge No. 1, Ganganagar on 23.9.97 by which he upheld the conviction and dismissed the appeal. Therefore, this revision has been filed. 3. Learned counsel for the petitioner did not challenge the conviction and he simply submitted that the learned Magistrate or the learned Addl. Sessions Judge did not consider the provisions of Section 360 Cr.RC. He prayed that the petitioner should be given the benefit of Probation of Offenders Act. 4. Learned PP has no objection. 5. In the facts and circumstances, the revision is partly allowed, while maintaining the conviction of the petitioner under Section 354 IPC, he is given the benefit of Section 4 of the Probation of Offenders Act. Consequently, it is ordered that if the petitioner, furnishes personal bond of Rs. 5,000/- together with a surety of the like amount to the satisfaction of learned Chief Judicial Magistrate, Sriganganagar to appear before the concerned Magistrate within a period of one year, if he is called upon to undergo sentence, and in the meantime to keep peace and be of a good behaviour, he shall be released forthwith. One months time is granted to furnish the bail bonds. 6. A copy of this order be immediately sent to the learned Additional Sessions Judge as well as learned Chief Judicial Magistrate, Sriganganagar.> Petition allowed. *******
