JUDGMENT 1. - The accused petitioner was convicted for offence under Section 323, 341 and 354 IPC by the learned Judicial Magistrate, Sri Ganganagar vide his judgment dated 16.8.94. The petition was sentenced as follows- (1) Under section 323 IPC, one month SI, (2) Under section 341 IPC, to a fine of Rs.100/- and in default to further undergo 7 days SI. (3) Under section 354 IPC, to three months SI and to pay a fine of Rs. 250/- and in default to further undergo 15 days SI. 2. The accused petitioner preferred an appeal before the learned Sessions Judge which was eventually heard and decided by learned Addl. Sessions Judge No. 1, Sri Ganganagar who dismissed it on 1.10.97. 3. Learned counsel for the petitioner did not challenge conviction & submitted that since the accused petitioner is a young boy, he should have been given the benefit under the provisions of Probation of Offenders Act. He has not challenged the conviction of the accused petitioner.Learned PP has no objection. 4. Consequently, the revision is partly allowed while maintaining the conviction of the petitioner under Section 323, 341 and 354 IPC he is granted the benefit under Section 4 of the Probation of Offenders Act. It is ordered that in case he furnishes a personal bond of Rs.5,000/- together with a surety of the like amount to i the satisfaction of learned Judicial Magistrate, Sriganganagar to appear before him within a period of one year and undergo the sentence and in the meantime be of a good behaviour and will keep peace, he shall be released forthwith. One month's time is granted to furnish the bail bonds.> Petition partly allowed. *******
