JUDGMENT : 1. The learned counsel for the petitioners states that certain States have still not filed their response. They are the States of Tamil Nadu, Karnataka, Kerala, Bihar, Arunachal Pradesh, Nagaland, Tripura, Meghalaya, Jammu and Kashmir, Haryana, Punjab (Mr. HS Munjral states that he is filing the affidavit today), Rajasthan, Mizoram and U.P. It will be presumed that they do not propose to file any affidavit since they have not done so even though time has expired and no request is made. Any State which still desires to file the affidavit may file it in the course of the day. 2. The National Human Rights Commission has filed an affidavit of Shri R.V. Pillai, Secretary General. Mr. Dasai, the learned Attorney General, states that while a copy of the affidavit has been served on him, the annexures to the affidavit have not been served. Mr. Sodhi states that he is just passing on the annexures to the learned Attorney General. The learned Attorney General states that he would need sum time to respond to the affidavit. Mr. Sodhi also seeks permission to file the annexures in the Court. He may do so in the course of the day. 3. Learned Attorney General also states that the Law Commission of India has since submitted its Report and there are certain recommendations made therein having a bearing on the question under examination in the present proceedings. He states that as soon as the Report is totalled before the Parliament, he would produce copies thereof for the perusal of this Court so that the views of the Law Commission formulated after discussion with concerned authorities could be of assistance to this Court. We quite agree with the learned Attorney General that it would be an important piece of material to which this Court would like to refer. 4. Mr. Sodhi is permitted to inspect the file to enable him to ascertain the views of those States which have filed their responses. List after two weeks.
