JUDGMENT : 1. We are informed that after the investigation made by the State Police, a charge-sheet has been filed and Sh. T. Das - the concerned Deputy Superintendent of Police of the C.B.I. is being prosecuted for offences punishable under Sections 341, 343 and 306 of the Indian Penal Code in the competent court. We are also informed that the amount of Rs. 2,10,000/- quantified by the learned District Judge, Cuttack as compensation will be paid, if not already paid to the widow and the five minor children of deceased Gopal Behera. The payment of compensation be made to the widow and the minor children of the deceased through the court of. Sub- Divisional Magistrate, Bhubaneshwar who will ensure payment of the amount directly to the claimants by depositing of the same in a nationalised bank within two months. The order of compensation to the widow and children of the deceased is on the same terms as directed in Nilabati Behera (Smt.) Alias Lalita Behera (Through the Supreme Court Legal Aid Committee) v. State of Orissa & Ors., (1993) 2 SCC 746 . 2. The writ petition stands disposed of. 3. We are thankful to the learned amicus and other counsel for the assistance rendered in disposing of the case.
