Honble GODARA, J. – Heard and considered. On perusal of the injury reports of Laliya and Sajaniya, though it appears that Sajania received a grievous injury on his left leg besides a fracture of borsum of right arm but, looking to the facts and circumstances besides the background of the incident, the accused-petitioners are in judicial custody since 18.11.1996 and therefore, without entering into merits of the case, since investigation has been completed and challan has already been filed, presently, it is just and proper that accused petitioners be granted bail. (2). Accordingly, this bail petition is accepted and it is ordered that in case accused-petitioners furnish bail bonds in the sums of Rs. 10,000/- each to the satisfaction of trial Court, they shall be released on bail. They shall give an under- taking that they shall not repeat commission of crime while on bail, before the trial Court.
