Honble MUKHERJI, C.J.–The applicant by this review application has sought a review of the order passed a Division Bench of this Court, comprising of Mr. Justice J.R. Chopra and Mr. Justice P.K. Palli, dated April 18, 1995. One of the Judges constituting the above Division Bench having retired and other having been transferred, this review application was heard by us. (2). The Division Bench observed that the learned Single Judge has rightly held that the promotion of the petitioner was not a substantive promotion and it was a purely temporary promotion. Since the substantive appointment of the petitioner was as Class IV employee the question of his absorption into other department on the post of Driver was also not considered. (3). In this review application the petitioner has averred that his promotion was against a vacant and substantive post and therefore, the order requires a review. (4). This ground for review is not within the purview of the powers of review as provided under Order XLVII Rule 5, CPC. This ground, if believed, disturbs the judgment under review on merits, which is obviously not the scope of review. The petitioner may have a case for appeal for which he has his chances but as regard review is concerned, the scope is very limited. The application of the petitioner is not framed according to the scope of review. Thus, there is no merit in this review application and the same is dismissed.
