JUDGMENT 1. :- I have heard learned counsel for the parties at length. Mr. O.C. Mathur learned counsel for the respondents states that in pursuance of the order dated 5.11.1990, which is subject matter of this contempt petition, the respondents have already complied with and are further ready and willing to comply with the directions of this Court contained in the said order. At this stage it will be appropriate to refer to the directions item-wise : (i) As regard the promotion of the petitioner from Junior Management Grade-I to M.M.G. Grade-II on the basis of interview, which was held by the respondents in the year 1981, the petitioner has already been promoted w.e.f. 1979 thus these directions are fully complied with by the respondents. (ii) As regard the second direction in respect of petitioner's promotion from the year 1979 from M.M.G. Grade-II to M.M.G. Grade-III, learned counsel for the respondents states that from their records the eligibility of the petitioner in this grade would be effective w.e.f. 1.5.1985. 2. With regard to the back-wages for the aforesaid period, it has been contended by the learned counsel that the wages and other benefits, which are admissible to the petitioner according to the Rules for the period 27.4.1982 to 1.5.1985 shall be paid by the respondents within a period of two weeks from the date of submission of certified copy of this order. 3. As regard the third direction i.e. promotion of the petitioner from M.M.G. scale III to M.M.G. (sic S.M.G.) scale IV since it is a consequential effect of the impugned order though not covered by the order as such the learned counsel for the respondents states that they are prepared to consider the eligibility of the petitioner for participating in the selection process for his promotion from Scale-III to Scale-IV and as soon as the said process commences, necessary intimation in this regard shall be conveyed to the petitioner before the commencement of the said process. 4. 4. With regard to the third direction of this Court as aforestated it will be appropriate to direct the respondents to consider his candidature for promotion subject to his suitability for the said promotional benefit from Grade III to Grade IV and in case he is found eligible for being given the benefit of this promotion, his eligibility shall be reckoned w.e.f. the 1985 batch from which his juniors were given he said benefit of promotion. 5. Hence, I am of the view that nothing further survives for consideration of this Court in view of the compliance of the aforesaid two directions already done as well as the assurance given by the learned counsel for the respondents for giving the promotional benefit to the petitioner with regard to the third direction as referred to above. 6. The contempt notice are discharged and the contempt petition is disposed of accordingly.Contempt petition disposed of. *******
