JUDGMENT : R.R. Jain, J. By this note for speaking to minutes, the petitioner-plaintiff seeks clarification in the judgment and order that came to be passed by this Court (Coram: R.R. Jain, J. (as he was then), on February 28, 1997 that "proper Court" is specified for the purpose of presentation of the plaint as ordered in the application Exh. 54. The order sought to be clarified clearly recites that the orders passed below applications Exhs. 28 and 29 were quashed and stood modified to the extent that the plaint be returned to the petitioner-plaintiff for presenting it to the proper Court. As a result of rejection of the application Exh. 54 of the petitioner-plaintiff, the plaintiff will have to present the plaint before the competent Court, and such Court is not required to be specified, as requested by the petitioner-plaintiff. There is no question of filing a fresh suit, nor any fresh cause of action arises as a result of the order passed in there Civil Revision Applications. 2. In the above view of the matter, there is no substance in the note for speaking to the minutes and it is accordingly rejected.
