JUDGMENT 1. - Heard learned counsel for the parties as well as learned Public Prosecutor for the State and also perused the documents on record. 2. Mr. Balwada submits that case of petitioner stands on much better footing than the case of co-accused Mahendra and Shri Ram. He has also placed reliance on the statements of Kurdaram, husband of deceased and the affidavit given by Kurda Ram. 3. Learned P.P. has not controverted these facts. 4. In the facts and circumstances of the case and the arguments advanced by both the sides, I am inclined to grant bail under section 439 Criminal procedure Code to accused petitioner. 5. It is, therefore, ordered that the accused petitioner Sanwara S/o. Rupa Ram shall be released on bail provided he furnishes a personal bond in the sum of Rs. 30,000 /- (Rupees thirty thousand) with two sureties in the amount of Rs. 15,000/- each, to the satisfaction of trial Court with the stipulation to appear in that Court as and when called upon to do so during pendency of trial against him. in this case.Bail allowed. *******
