JUDGMENT S. B. Sinha, J. : All these applications were taken up for hearing together, in as much as it was being contended by Mrs. Mukherji on behalf of the State and several learned counsel appearing on behalf of West Bengal State Electricity Board that various problems have arisen in granting water availability certificate and in granting electrical connection for installation of submersible pumps. At my suggestion, both Mr. P. K. Majumdar, Senior Geologist and Superintending Engineer of Burdwan District Mr. Saha are present in court. They have placed before this court the difficulties which are being faced by the said authorities in writing. 2. Having heard the learned counsel for the parties and having considered the difficulties placed before this court by the Senior Geologist as also by the Superintending Engineer, West Bengal State Electricity Board, these applications are disposed of with the following directions : (1) The Superintending Engineer, West Bengal State Electricity Board, Burdwan and the Senior Geologist, Burdwan would hold a meeting within I week from date so as to enable them to exchange their views so that one department may render maximum cooperation to the other. The Superintending Engineer, may, upon consideration of the relevant records point out the areas keeping in view the priority as also the feasibility aspects for supply of electrical energy, and the Senior Geologist shall start making investigation for the purpose of consideration of the applications for grant of water availability certificate in such areas, on a priority basis. It is made clear that both the Senior Geologist as also the concerned Station Superintendent would act only when an application furnishing all necessary details are filed and not otherwise; (2) All such applications should be considered serially, wherefor, both the Senior Geologist as also the Station Superintendent shall maintain a register. The Superintending Engineer is requested to make inspection of such register from time to time or cause the same to be made by any officer authorised by him; (3) In case it is found that any connection has been given without obtaining any water availability certificate or without other statutory formalities being complied with, the Superintending Engineer would be at liberty to take such disciplinary action as against the concerned Station Superintendent as he may deem fit and proper and further take such action as against the consumer concerned, in accordance with law. 3.

As regards financial aspect, keeping in view the fact that Burdwan District has attained same in respect of its agricultural activities, this court feels that all concerned should come forward to alleviate the difficulties of the agriculturists so as to enable them to get enough water for the purpose of irrigating their agricultural lands. It is expected that the Chairman, West Bengal State Electricity Board shall consider the matter with due importance it deserves and tap all available resources, some of which have been mentioned in the report of the Superintending Engineer. State of West Bengal is also expected to consider the matter in its right earnest and render sufficient financial assistance to the West Bengal State Electricity Board. If the concerned Sabhadhipaties have any fund for the purpose they are also required to release such funds in favour of West Bengal State Electricity Board. 4. However, if in a given case, consumers themselves come forward to bear the entire costs for installation of the transformer and/or the service line, the electrical connection may be granted to such consumers subject to the condition that the costs borne by the respective consumer would be adjusted from their bills for consumption of electrical energy in such proportion, as the parties agree and the extent of such extra cost to be borne by each consumer may be settled across the table by and between the Superintending Engineer and representative(s) of the concerned consumers. 5. Water availability certificates, keeping in view the peculiar facts and circumstances of this case, shall not be granted only for a period of 3 months, but shall be for a period of 3 years, in as much as, in view of the statements made by the respondents themselves consumer is not sure when he would be able to get electrical energy for the purpose of installation of submersible pump. However, in an exceptional case and for reasons to be recorded in writing, Senior Geologist in a given case, may withdraw such certificates. 6. It is expected that the Senior Geologist, keeping in view the fact that only 982 applications are pending, would be able to complete investigation and grant certificates within a period of 6 months from the date of filing of each application.

It may be placed on record that the Senior Geologist, has stated before this court that 600 certificates are already ready, but the applicants concerned have not come forward to collect the same and more than 700 applications have been sent back to the Subhadhipaties concerned for certain informations. 7. The applicants would be entitled to file their applications directly, if they so choose, and such applications should not be rejected either by the Senior Geologist or by the Station Superintendent concerned only because the same had not been forwarded by the concerned Gram Panchayat etc., Such direct applications would not be entertained in the event the applicant is not in a position to prove his identity. 8. If any application has been cancelled on the ground that no new connection is being considered for Village Sub-station, such decision shall be considered afresh in the light of the aforementioned decision. The Station Superintendent as also the Senior Geologist may communicate this order to all concerned, including the concerned Panchayat, Zilla Parishad and Panchayat Samity, etc. 9. I hope and trust that keeping in view the importance of supply of electrical energy for installation of submersible pumps, all concerned, including the State of West Bengal and West Bengal State Electricity Board would give all priorities to the problems of the agriculturist of the District.
