( 1 ) THIS is an appeal under Section 54 of the Land Acquisition Act, 1894 (hereinafter referred to as "the Act") against award and decree dated 27. 3. 85 passed by the learned Additional District Judge, Delhi, determining the amount of compensation and other statutory benefits payable to the respondent herein for acquisition of his land situated in Village Bhalsawa Jahangirpur, Delhi. ( 2 ) THE piece of land in question was acquired by notification under Section 4 of the Act dated 25. 3. 1977. Declaration under Section 6 of the Act was issued on 26. 4. 78 and Award was made by the Land Acquisition Collector on 29. 12. 78. ( 3 ) RFA No. 306/85 was filled by the respondent herein asking for enhancement of compensation, which was allowed by judgment dated 15. 7. 96. ( 4 ) IN the present case the appellant/union of India has challenged the direction for payment of additional amount calculated @ 12% per annum from the date of notification under Section 4 till the date of award and the date of taking possession of the land under Section 23 (1 A) of the Land Acquisition Act. ( 5 ) SINCE the award was made by the Collector before 30th day of April, 1982, the respondent would not be entitled to the additional payment under Section 23 (1 A) of the Act. The direction given for the payment thereof is set aside. Consequently, the impugned award and decree is modified to that extent. ( 6 ) THE appeal of the Union of India is accordingly allowed. No costs.
