Judgment : 1. In this petition filed under Section 482 of Code of Criminal Procedure, the petitioner has prayed for a direction to the respondent No. 1 to entrust the investigation of the Complaint lodged by the petitioner and registered as Crime No. 377 of 1996 dated 13. 9.96 on the file of the Sub Inspector of Police, Kudavasal Police Station to any other independent Investigation Agency such as C.B.C.I.D. or C.B.I. or to issue such other suitable directions. 2. On behalf of the respondents, the learned Government advocate submitted that a complaint has been received by the Police on 30.9.96 in respect of on incident which has taken place on the night of 19. 96 and case has been registered in Crime No. 377 of 1996 for an of fence punishable under Section 379 of IPC. In the said complaint, the complainant has stated that he suspected two persons who have committed the theft. He has further stated that during investigation, 5 witnesses were examined and attempts were being made to trace out the suspected accused and since they are absconding, they have not traced till now. He has produced the case papers before me. 3. Since the investigation has already commenced and is half way through, at this stage, it will not be proper to entrust the investigation to any other independent Investigating Agency. However, I direct the respondents to investigate into the matter expeditiously and to file a charge sheet within a period of 4 months and the Investigating Agency should take all necessary action to arrest the suspected persons whose names have been mentioned the complaint and interrogate them. A charge-sheet should be filed in this case if the facts reveal a case against these persons within a period of 4 months. 4. With the above observation, this Criminal Original Petition is closed.
