JUDGMENT : 1. An affidavit has been filed on behalf of the Govt. of U.P. by the Additional District Magistrate (Executive), Distt. Agra, in which inter-alia, it is stated that the State is willing to provide a site near the present bus stand, located in Mauza Araji Imlak in survey plot No. 127, which site is presently lying unoccupied to the shopkeepers for setting up their Dhoopbatti and and Chadar shops, on licence basis. It is stated that the shopkeepers have submitted their willingness to shift their Dhoopbatti and Chadar shops at the proposed site. In the reply affidavit filed by Mohd. Yaseen, a nominee of the Administrator of the Dargah Wakf, it is stated that the site which has been offered by the State of U.P. is wakf property. Learned counsel for the State of U.P. states that the State has already addressed a communication to the wakf Board seeking its consent to allotment of the site, in question, to the shopkeepers for setting up Dhoopbatti and Chadar Shops and that the reply from the wakf Board is awaited. Learned counsel prays for four weeks adjournment to report further action. Adjournment is granted. 2. It has been brought to our notice that shooting of some film has been permitted, inside the Mosque and around the Dargah, by the Archaeological Survey of India. Learned counsel for the petitioner in Writ Petition No. 455/98 submits that such activities should not be permitted. Learned counsel for the Archaeological Survey of India is directed to state on affidavit his response to the above allegation in four weeks. It is, however, directed that no such activity, which is not connected with the affairs of the Jama Masjid or the Dargah, should be permitted by the Archaeological Survey of India inside the Mosque or the Dargah, till further orders. 3. List the matter after four weeks.
