JUDGMENT 1. - Heard learned counsel for the petitioner(s) and the learned Public Prosecutor. Case diary perused. 2. The accused petitioner was not named in the FIR. The charge sheet of the case has been filed. The incident said to have been taken place in the intervening night on 27th and 28th September, 1996. The star witness of the case is Gopal, whose statement was recorded by the Investigating Officer on December 27, 1996. The accused petitioner is in judicial custody for the last ten months. 3. Taking into consideration all the facts and circumstances of the case, I am inclined to release the petitioner/s on bail under section 439 Cr.P.C. 4. It is, therefore, ordered that petitioner Mannalal S/o Madhu shall be released on bail, provided he each of them furnishes a personal bond in the sum of Rs. 20,000 /- (Twenty Thousand) with two sureties in the sum of Rs. 10,000 /- (Ten Thousand) each in the like amount to the satisfaction of the trial Court with the stipulation to appear in that court or any other court on all subsequent dates of hearing and as and when he is/they are call upon to do so during the pendency of trial/investigation/enquiry as the case may be.Bail application allowed. *******
