JUDGMENT 1. - Heard the learned counsel for the applicant and the learned Public Prosecutor. 2. A perusal of the medico-legal report of the injuries of Gopal Nath shows that he received only two incised wounds. One incised wound on the right temporal region and it has been mentioned as a simple injury. Second incised wound was on the upper part of right ear. It is this injury which according to the prosecution was grievous one. 3. In the facts and circumstances of the case the application of Malu Nath under section 439 Cr.P.C. is hereby allowed. He shall be released on bail provided he furnishes two sureties of Rs. 5,000/- each and personal bond of Rs. 10,000/- to the satisfaction of the learned District and Sessions Judge, Sri Ganganagar.Bail application allowed. *******
