JUDGMENT 1. - Pursuant to a petition of compliant being filed against the present applicants before a Judicial Magistrate at Bassi, the matter was transferred before the Judicial Magistrate at Tonk who passed an order under section 156(3) Cr.P.C. directing the police to investigate and FIR No. 123/97 came to be registered at Police Station Kotwali, District Tonk, on 10/5/1997 for the offence under sections 379, 420, 468, 477, read with 120-B IPC. The complaint was filed by Ram Sahai S/o one Harnath. Police is now investigating into the matter. The contention of the applicant No.1 Hira Lal is to the effect that he got a tractor purchased from Ram Sahai in 1993 in exchange of his old tractor and also a cash amount of Rs. 68,000/- and after his purchase he got the tractor, which was delivered by Ram Sahai, insured in his name. There was a sale letter executed by the original owner Jeeta and it was attested by a gazetted officer who is a medical officer. The tractor which was the subject matter of the transaction was law-fully registered in the name of Hira Lal and after a few years of his own use he got it sold to Mehram, applicant No.2. It, however, transpires that the original owner Jeeta died in 1989 but the transfer letter, allegedly executed by Jeeta, dated 5/6/1990 is executed by the said Jeeta and apparently it seems obvious that the transfer letter which was obtained by Ram Sahai was a fabricated one. In the background of the user of the tractor for a considerable number of years and the same being registered in his own name by the applicant No.1 Hira Lal and he subsequently transferring it in the name of applicant No. 2 Mehram. There may be also a plausible story of the applicants being involved in a Criminal Case at the behest of Ram Sahai in a malafide manner. It would be for the police to investigate the matter fully so as to bring out the truth for the complicity of the present accused applicants at the appropriate stage. 2. Ten Thousand) each and in case they are arrested they may be released on bail subject to their giving an undertaking that they would cooperate with the police Investigation by way of participating in the interrogation as and when necessary and they shall not dissuade any person knowing about the facts of the case from testifying about the same either before the police Investigating Officer or before the Court.
