JUDGMENT : 1. The submission of learned counsel for the petitioner is that the petitioner does not challenge the correctness or effect of this Court's order dated 13th September, 1996 passed in I.A. No. 18 in W.P. (C) No. 4677/ 85 (M.C. Mehta v. Union of India and Ors.), but the application thereof by the Environmental Impact Assessment Authority to the petitioner. The learned counsel submits that the writ petition filed by the petitioner in the High Court which has been dismissed by the impugned judgment is based on an independent cause of action unaffected by this Court's earlier judgment. On this basis, it was contended that the High Court has erroneously assumed that the effect of this Court's earlier judgment is to negative the petitioner's contention. The learned counsel also made it clear that I.A. No. 48 filed by the petitioner in I.A. No. 18 in W.P. (C) No. 4677/85 was clearly mis-conceived and, therefore, rejection of that I.A. by an order dated 18.2.97 is not challenged in any manner. 2. Issue notice on the special leave petition as well as on the stay application. The matter be listed in a week commencing 14th July, 1997. Dasti service is permitted in addition.
