JUDGMENT 1. - The petitioner, who is a servant of licence holder has filed this revision petition against the order dated 12.7.1995 passed by the learned Judge in Sessions Case No. 7/93 whereby the learned Judge framed the charge under section 26(b) of the NDPS Act. Section 26(b) reads as under : 26. Punishment for certain acts by licensee or his servants:-If the holder of any licence, permit or authorisation granted under this Act or any rule or order made thereunder or any person in his employ and acting on his behalf:- (a) .................................. (b) fails to produce without any reasonable cause such licence, permit or authorisation on demand of any officer authorised by the Central Government or State Government in this behalf; (c) ................................... (d) ................................... he shall be punishable with imprisonment for a term which may extend to three years or with fine or with both. 2. In this case, the shop was searched on 4.4.1992. That time the petitioner, being servant had no licence with him as it was with the owner of the shop. Learned counsel Shri Punia had shown the original licence for the perusal of the Court. It appears from the said licence that there was only one licence given to the petitioner for 11 shops at different places in Nagaur District, On the next day, the licence holder immediately produced the licence before the S.H.O. Section 26(b) of the NDPS Act provides that if the person fails to produce without any reasonable cause such licence then only offence is committed. From the facts of this case, it is clear that there was a reasonable cause for the petitioner accused not to produce the said licence when the shop was searched as it was with his master. Hence, the learned Judge was in error in framing charge against the accused for offence punishable under section 26(b) of the NDPS Act. 3. In view of the above discussion, this petition is allowed, the impugned order, dated 12.7.1995 passed by Sessions judge, Merta camp Parbatsar in Sessions Case No. 7/93 is hereby quashed and set aside and the proceedings initiated against the accused for offence punishable under section 26(b) of the NDPS Act are hereby quashed.Revision allowed. *******
