JUDGMENT : 1. On 27th June, 1997 this case was fixed for hearing when two Minutes were handed over in the Court. It appeared from the Minutes of the first meeting dated the 25th June, 1997 (11.30 a.m.) between Mr. Madhu Dandavate and Mr. Raghuvansh Prasad Singh that Mr. Singh was doing his best to obstruct the holding of the election and indefinitely defer it. He was not willing to carry out the order of the Court although he took it upon himself to do it. 2. However, from the Minutes of the second meeting dated the 26th June, 1997 at 3.00 P.M., an impression was sought to be given by Mr. Singh that he had undergone a change of heart and was willing to go on with the finalisation of the voters list and holding election as directed by the Court on 3rd July, 1997. In that view of the matter we deferred passing of any order on 27th June, 1997. 3. It now appears that the deferment of the decision by this Court has not improved the matter. We are now informed that an attempt was made by Mr. Singh and Mr. Dandavate to sit together and arrive at a final list of voters, that has not been possible. 4. The attitude of Mr. Singh, the second nominee of respondent No.1 appeared to be strange in the first meeting itself when he asked for deferment of the finalisation of the list of voters and holding of the election contrary to the direction of this Court. 5. After hearing the parties and having regard to the facts and circumstances, we are of the view that Mr. Singh is in effect trying to stick to the stand he took in the first meeting by obstructing finalisation of the voters list and compel the Court to defer the election. Under these circumstances, we direct that Mr. Madhu Dandavate alone will finalise the list of voters, fix the venue and hold the election as scheduled after finalising the list of voters immediately. All other directions given previously by this Court will be carried out by Mr. Dandavate. It is only after the elections are held and the results are announced that any aggrieved party will be entitled to challenge the election.
