JUDGMENT 1. - This revision petition is directed against the order dated 29.8.1998 passed by learned Spl. Judge, Jodhpur in Cr.Rev. No. 15/98 whereby he set aside the order of learned Judl. Magistrate accepting the final report and gave certain directions. 2. Smt. Sita Devi had filed a complaint in the Court of Judl. Magistrate, Bilara which was sent to the police under section 156(3) Cr.P.C. for investigation. The police after investigation submitted final report. Learned Magistrate accepted the final report and dismissed the protest petition filed by the complainant. Against that order, the complainant preferred a revision petition before the learned Sessions Judge which was heard by learned Spl. Judge and was allowed by the impugned order. 3. Mr. Garg, contends that learned Spl. Judge has committed an error in directing the Magistrate to direct the police to investigate the matter in particular manner. He does not object to the acceptance of revision petition by the learned Spl. Judge, but according to him, no directions could be given for conducting the investigation in particular manner. 4. There is merit in the contention of Mr. Garg. The Magistrate is empowered to direct further investigation, when the police submits F.R., but it is not permissible that the Magistrate binds-down the police to investigate in particular manner or recover the articles. The Magistrate can order that further investigation be conducted on the allegations of the complainant. In the instant case, the learned Spl. Judge has given direction with regard to making of investigation in a particular manner. He has been directed the recoveries to be made. Such direction could not be given in exercise of revisional jurisdiction. The directions given in this regard are liable to be quashed. 5. Consequently, this revision petition is partly allowed. This part of the order of Spl. Judge is set aside wherein it was directed that investigation shall now be made in particular manner or with regard to the allegations of particular paragraphs. The learned Magistrate may direct the 1.0. to make further investigation in the light of observations made above.Revision allowed. *******
