JUDGMENT 1. - Heard. Perused the case diary/copy of challan papers made available for perusal. This is bail application under section 439 Cr.P.C. and the accusation against the accused-applicant is for the offence under section 302 & 201 IPC. Perused the statements of Heera and Vaja. It is submitted that Co-accused Sama stated to the above witnesses that petitioner Daja Ram told him that he inflicted Kulhari blow to the deceased Amariya. Sama Co-accused has been released on bail on 13.10.1998. Learned Public Prosecutor opposed the bail petition. 2. Upon consideration of over all facts and circumstances of the case and taking into account the oral arguments advanced by both the sides. I think it proper to enlarge the accused applicant(s) on bail. 3. Therefore, this bail application is allowed and it is ordered that the applicant(s) namely Daja Ram S/o Jawaji Kalbi be released on bail provided he executes personal bond for a sum of Rs. 10.000/- (Rs. Ten thousand only) and furnishes one sound and solvent surety in the like sum to the satisfaction of the learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial.Bail application allowed. *******
