ORDER : Mr. Nariman, learned senior counsel appearing for the State of Karnataka submits that without in any way raising the existing solid crest level beyond 509 metre or in any way obstructing the free flow of water, the State of Karnataka prays for the following interim directions: "(ii)(a) To pass an interim order permitting the State of Karnataka to proceed with the works of (a) placement of trunnion assembly, (b) placement of radial arms, (c) placement of horizontal girders, (d) providing bracings between the arms and the girders and (e) hoist assembly." 2. Mr. Parasaran, learned senior counsel appearing for the State of Andhra Pradesh has serious objections to the above prayer being granted. It is submitted that the grant of the prayer may be mis-interpreted by the State of Karnataka as a permission or leave from this court to carry on with the activity, which, according to the State of Andhra Pradesh, is in breach of the orders made by this court and otherwise also unauthorised and illegal. 3. After hearing learned counsel for the parties, we grant prayer (ii)(a) (supra). It is, however, clarified that the work to be carried on by the State of Karnataka on the basis of prayer (ii)(a) (supra) would be at the risk and cost of the State of Karnataka and shall be without prejudice to the rights of the State of Andhra Pradesh, both in the Suit as well as the injunction application and the pending Contempt Petition. The undertaking on behalf of the State of Karnataka, not to raise the crest level beyond 509 metre for the present, shall be filed during the course of this week, on the affidavit of a ' responsible official of the State of Karnataka. 4. I.A. No. 7 is, accordingly, disposed of.
