JUDGMENT 1. - From the injury report, it appears that the injured Mahendra Kumar has sustained one abrasion and one incised wound. Both the injuries are simple in nature. Prima facie, offence under section 307 IPC does not appear to have been made out. Hence, I am inclined to grant pre-arrest bail under section 438 Cr.P.C. to the accused-petitioner. 2. The SHO/Arresting Officer/Investigating Officer Police Station Kishorepura, Kota is therefore, directed that in the event of arrest of the petitioner Deepak Shringi son of Moolchand Shringi, by caste Brahmin, r/o Chhwani, Kota, P.S. Gumanpura, Kota, in FIR No. 172/97 P.S. Kishorepura, Kota, he shall be released on bail, provided he furnishes a personal bond in the sum of Rs. 5,000/- (Rs. five thousand only) with one surety in the like amount, to the satisfaction of the SHO concerned, on the following conditions. 1. that the petitioner shall make himself available for interrogation by a Police Officer as and when required. 2. that the petitioner shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case, so as to dissuade him from disclosing such facts to the Court, or any Police Officer.
