JUDGMENT 1. - Both these petitions arise out of FIR No. 12/98 Police Station, Bali registered against the accused-petitioner and his co-accused under section 19/54 of the Rajasthan Excise Act. Hence both these petitions are disposed of by this common order. 2. Learned counsel for the petitioner submits that truck in which the alleged liquor recovered in huge quantity was being transported by Bhanwarlal on behalf of Heeralal Vishnoi to Pali and his submission is that present petitioners who are driver and Kha Iasi of the truck have a different case from Bhanwarlal and Heeralal Vishnoi and therefore his submission is that looking to the maximum punishment prescribed for the alleged offence, the petitioners do not have any other disability from being released on bail. 3. However, learned P.P. looking to the huge quantity of the liquor being transported illegally opposes this petition. 4. On consideration of rival contentions, presently, the case of the petitioners is distinguishable from Bhanwarlal co-accused and, consequently, these petitions deserve to be accepted. Accordingly, it is ordered that petitioners Lalu Ram and Amar Singh shall be released on bail provided each of them furnishes a personal bond in the sum of Rs. 20,000/- and one surety bond in the like amount to the satisfaction of the trial Court for their appearance before that Court on the next date of hearing and on all subsequent dates whenever called upon to do so till the final disposal of the case. They shall have to undertake that while on bail, they shall repeat such offence nor shall they have involved in illegal transportation or possession of liquor or any other contraband.Bail application allowed. *******
