1998-03-02

V.G.PALSHIKAR

body1998
JUDGMENT 1. - The petitioner has challenged the order granting interim maintenance to the respondents. The basic reason for challenging the order of main-tenance is the fact that marriage between the petitioner and respondent has been duly dissolved by the Court of competent jurisdiction and the petitioner has also been acquitted of the offences under sections 342 & 498-A.IPC. According to the learned counsel for the petitioner, these events are not at all considered by the learned Judge while granting interim maintenance. Though the events are subsequent in nature but they have direct bearing on the issue of granting interim maintenance. Hence, the revision petition is _dismissed with the direction to the petitioner to approach the learned Magistrate for varying or revoking the order of interim maintenance. The petitioner shall be at liberty to raise all the questions regarding correctness of granting maintenance before the learned Judge. The learned Judge on appreciation of the material placed before him decide the matter in accordance with law as far as possible within four months.Revision dismissed. *******
