JUDGMENT 1. -The accused petitioner has filed this petition under S. 482 Cr.PC. for quashing FIR No. 306 of 1996 of Police Station, Chirawa for the offences under Sections 420, 467, 468 and 471 I.PC. registered against the accused petitioner. 2. The petitioner is a Fair-Price Shop Dealer in Gram Panchayat. Bukhana, On the basis of the certificate issued by the members of the vigilance committee, the petitioner was issued stock of fair price articles for distribution. One Dana Ram, a member of the said vigilance committee lodged a FIR on 2.12.76 against the petitioner that by using forged signatures of the members of the committee, he was lifting quota of fair price articles. On the basis of this FIR, a case was registered against the petitioner and his licence of fair price shop was suspended on 10.1.97 by the District Supply Officer. Jhunjhunu. 3. The learned counsel for the petitioner has submitted that the above FIR was lodged under misconception. The complainant Dana Ram executed an affidavit (Ann. 2) on 23.1.98 that the petitioner did not commit any offence in as much as the certificate was correctly issued by the members of the vigilance committee. The FIR was lodged on account of some doubts. 4. Rajveer Singh, the another member of the committee also wrote a letter (Annexure 3) to the Investigating Officer that the petitioner has not committed any offence Shish Ram, a member of the said committee has also executed an affidavit (Annexure 4) on 2.5.97 that the certificate was issued by the members of the vigilance committee and the petitioner has not committed any offence. 5. The learned counsel for the petitioner has submitted that except Dana Ram, two other members of the committee appeared before the Investigating Officer and have stated the above facts. However, Dana Ram has appeared before this Court, who has been identified by his counsel Shri Gajendra Singh. Thus, from the affidavits of Dana Ram & Shish Ram as also the letter of Rajveer Singh it is clear that the certificate was issued by the vigilance committee and it was not a forged document. The FIR has been lodged under misconception or on account of entertaining some doubt. 6.

I have also gone through the affidavits of Dana Ram & Shish Ram as also the letter of Rajveer Singh and have come to the conclusion that these members of the vigilance committee themselves have stated that the certificate was issued by them and the petitioner has not committed any offence. Thus, it is a good ground for quashing the FIR No. 306 of 1996 of Police Station, Chirawa, District Jhunjhunu. 7. For the above reasons, I accept this petition and quash the FIR No. 306 of 1996 of Police Station, Chirawa, District Jhunjhunu.FIR quashed - Petition allowed. *******
