Order In this case also many disturbing state of affiars have been disclosed. The petitioner's husband died on 13.3.1973 while working as the Assistant Teacher in Primary School Narhi, Koelwar, Bhojpur. The case of the petitioner is that the retirement benefit by way of gratuity, family pension and provident fund has not been paid to her. From Annexures 9 and 10 to the writ petition written by respondent nos. 9 and 6 respectively it appears that clear direction has been given for payment of retirement benefit of the petitioner in question. 2. The petitioner is the legally married wife of the deceased teacher Janbahadur Mahto. In view of the said two orders being Annexures-9 and 10 which are already on the record, this Court quashes annexure-1 to the writ petition and directs that payment of the entire gratuity amount, Provident Fund amount and family pension including arrears of family pension be made available to the petitioner on the basis of the sanction order to be issued by respondent no. 4 within a period of two months from today. On the basis of the said sanction order to be issued by respondent no. 4 within the period aforesaid, respondent no. 5 will issue the necessary authority slip within a month of receipt of the said sanction order. It is further made clear that in so far as the payment of gratuity is concerned, the statutory interest must be paid to the petitioner. The time frame indicated in this order is peremptory in nature and must be strictly followed and any deviation from the same will be viewed very seriously by this Court. 3. Since the husband of the petitioner died in 1973 and it is an old matter, this Court did not want to give further opportunity to the learned counsel for the State to file counter affidavit. 4. With the above direction, this writ petition is disposed of. There will be no order as to cost.
