C. M. Nayar,j. ( 1 ) THE present petition is filed under Section 276 of the Indian Succession Act, 1925 for grant of Probate in respect of the Will dated February 27, 1982 of late Shri G. P. Nathani. ( 2 ) THE Testator expired on November 18, 1994 at Delhi leaving behind three sons, namely, Krishan Kumar, Lakhan Lal and Kamal Kumar and three daughters, namely, Nanki, Mohini and Prem Lata. According to the petitioners, Shri G. P. Nathani had made and executed a Will dated February 27, 1982 (Exhibit C-1) which is the last Will and testament of the deceased and executed by him. The petitioners have been named as executors of the Will for giving effect to the bequest in accordance with the said Will. Bakhru Resident of G-14, Naka Madar, UIT Colony, Gandhi Nagar, Ajmer-305001 Daughter 5. Smt. Mohini W/osh. D. N. Bhatia B/128-A, Sector-K, Aliganj Scheme, Lucknow-226020 Daughter 6. Sh. Anand Kumar, husband of deceased daughter Smt. Prem Lata Son-in-law 7. MASTER Rajesh Kumar son of Shri Anand Kumar, minor Grand son 8. Master Rakesh Kumar son of Sh. Anand Kumar, minor Grand son through their father ALL residents of flat No. 42-C, BG-III, Paschim Vihar, New Delhi-63 ( 3 ) THE deceased Shri G. P. Nathani left behind the property as described in Schedule `a to the petition i. e. One two storey built up house bearing No. 16, Road No. 8, Punjabi Bagh Extension, New Delhi 110026. ( 4 ) NOTICE of the petition was issued to the respondents and the collector. Citation was also ordered to be issued and published in the newspaper `indian Express dated January 31,1997. The respondents and the Collector have been duly served. The Valuation report has been filed. Respondents 2 to 9 have filed affidavits and raised no objections to the grant of probate in favour of the petitioners. ( 5 ) THE attesting witnesses to the Will are Mr.

Singhal and Dr. Ved Mitra B. Sharma. In his statement Mr. Krishan Kumar Nathani Public Witness 1 has stated that his father Shri G. P. Nathani executed the Will Exhibit C-1 dated February 27, 1982 and he identified the signatures of his father on the same. Statement of Dr. Ved Mitra B. Sharma one of the attesting witnesses to the Will was recorded which reads as follows: "i am Doctor by profession and doing private practice. I had known Mr. G. P. Nathani who executed the Will dated 27th February, 1982 as he was our neighbour. I signed the Will as an attesting witness in the presence of the Testator and another witness Mr. D. K. Singhal also signed. The Will Exhibit C-1 was signed in each other s presence. I identify the signatures of the Testator. The mental condition of Shri G. P. Nathani was sound. " ( 6 ) IN view of the facts as stated above and particularly when there is no opposition to this petition by legal heirs, I allow the petition and grant Probate in respect of the Will dated February 27, 1982 Exhibit C-1 exeucted by Shri G. P. Nathani in favour of the petitioners subject to their furnishing of requisite court-fees and necessary Administration Bond with one surety.
