ORDER : Heard learned counsel for the parties including learned counsel for the respondent Corporation and the Union of India. 2. This writ petition was filed by the petitioner complaining of the fact that he was not granted promotion to the post of Deputy General Manager but his juniors were promoted to the said post. 3. It is well known that grant of promotion is a managerial function. The post of Deputy General Manager is a fairly high post and promotion to such a post is certainly a selection promotion. No body can have a right to such promotion. The only right which is recognized is a right of being considered. From the counter affidavit which has been filed in this case, this Court finds that the case of the petitioner for promotion to the post of Deputy General Manager was considered in 1992, 1993 and subsequently also in 1994 and 1995 but the authorities did no find the petitioner fit for promotion. In paragraph 44 of the counter affidavit it has been said that promotion in such matters is granted on a consideration of the overall suitability of the candidate and the Departmental Promotion Committee in such cases consists of General Manager, Incharge BHEL Power Sector Eastern Region and the Executive Director, BHEL Bangalore based Division. Both these are very highly placed Officers. The petitioner has not alleged any bias against them. Therefore, any consideration by them cannot be interfered with by this Court just because the petitioner was not found suitable for promotion. 4. Ultimately pursuant to the ORDER :of this Court dated 19.4.1996 the petitioner's case was considered and he was given promotion to the said post for a period of three months prior to his retirement and such promotion was given to him on compassionate ground even though the petitioner did not come within the best first ten candidates. This shows that there was no bias against the petitioner. 5. In that view of the matter, this Court does net find any reason to interfere with the action of the respondents. This writ petition is thus dismissed. There will be no ORDER :as to cost.
