Honble SHETHNA, J.–Original petitioner Shiv Singh filed this petition in 1991 and prayed that the respondents be directed to give promotions to him to the higher post when his juniors were promoted and to grant all consequential benefits of service. The claim was made on the basis of the judgment of this Court dated 23.10.89 (Hon. Miss K. Bhatnagar, J. as she then was), delivered in S.B.C.W.Pet. No. 1074/87 filed by him, whereby his writ petition was allowed and he was granted seniority from the date of his initial appointment. However, there was no further direction to grant him consequential benefits. (2). In reply affidavit, the respondents have pointed out that the original petitioner concealed the material fact that he was promoted by an order dated 3.10.86 but he did not accept it, therefore, it was cancelled. They have also stated that the earlier judgment of this Court delivered in the aforesaid writ petition was complied with by them in its letter and spirit. (3). The petitioner died during the pendency of this petition, therefore, his L.Rs. have come on record and prosecuted this petition. (4). Mr. Choudhary, learned counsel for the petitioner, submitted that the petitioner should be given notional promotion from the date on which his juniors were promoted to the higher post. He claimed it only on the basis of the previous judgment delivered by this Court in his earlier writ petition. As stated earlier, the relief which was claimed and granted was only to the effect of granting seniority and nothing more. In absence of any clear or specific direction to grant all consequential benefits, the original petitioner cannot be given notional promotion. That apart, the petition filed by the original petitioner suffers from the vice of suppression of material fact, which has been pointed out in the reply affidavit by the respondents, namely that the petitioner has concealed that he was promoted but his pro- motion was to be cancelled because he refused to accept it. (5). In view of the above, this petition has to be dismissed. Accordingly, it fails and is dismissed with no order as to costs.
