VIRENDRA SARAN, J. ( 1 ) HEARD learned Counsel for the applicant. ( 2 ) SMT. Madhu Singh has preferred this application with the allegation that she has entered into marriage with Shiv Bodh Singh. It has been stated that in para 4 of the affidavit that the applicant is aged about 20 years. It is further mentioned that the applicant herself left her parental house and is living happily with her husband but on the basis of a false FIR lodged by applicants father at PS under Sections 366/ 506, Indian Penal Code, the police is harassing her husband and the father-in-law. Learned Counsel has submitted that the police is trying to illegally arrest the applicant and in case the applicant falls in the hands of the police, the applicant may be coerced to make statement in line with the prosecution case. ( 3 ) THE applicant has filed photo-copy of High School Certificate showing her date of birth as 20. 1. 1979 (Annexure-2 ). She has also filed Marriage Certificate issued by Arya Samaj (Annexure-3 ). Photographs showing some marriage ceremony being performed (four photographs in Annexures-4 and 5) and marriage certificate issued by Registrar, Hindu marriages, Lucknow (Annexure-6) have been filed alongwith the application. ( 4 ) THE applicant and her husband Shiv Bodh Singh have also appeared before me. From her appearance the applicant appears to be a major. The applicant personally requested that her statement be recorded and she informed the Court that she has willingly entered into marriage with Shiv Bodh Singh. She further informed the Court that she herself left the parental house. Since this is an application under Section 482, Criminal Procedure Code I am not inclined to record the statement of the applicant and have simply noted the oral information given by the applicant at the time of hearing of this case in this order. Considering the totality of the circumstances, it is desirable that statement of Smt. Madhu Singh under Section 164, Criminal procedure Code be recorded. ( 5 ) ACCORDINGLY, it is directed that the applicant may appear before CJM Lucknow, and on the production of a certified copy of this order, learned CJM shall record the statement of the applicant under Section 164, Criminal Procedure Code. The applicant shall supply her photograph to be affixed on the original statement so recorded.

A copy of the statement recorded by learned CJM shall be sent to the Investigating Officer of Crime No. 162/98 under Sections 366/506, Indian Penal Code, P. S. Aliganj, Lucknow, and one copy shall be supplied to the applicant without delay. The original statement recorded shall be sent to Magistrate incharge of cases of P. S. Aliganj. ( 6 ) WITH the above direction this application is disposed of finally. .
