Manish v. Board of Education

DEEPAK VERMA

body1998
JUDGMENT Shri Piyush Mathur, counsel for the respondent, made an offer to the petitioner that if corrected original mark sheet is returned to the respondent, then after verifying the records the discrepancy that may be pointed out by the petitioner would be removed. He further submitted that a fresh mark sheet would then be issued to the petitioner within a period of one week hereof. This substantially satisfies the relief as claimed by the petitioner. The original mark sheet has been returned to the Divisional Officer in presence of the Court. He also gives an undertaking to get it corrected after verifying the record and to send the same to the petitioner by registered post A.D. On failure on the part of the respondent to comply would expose him for committing contempt. In view of the statement made by the learned counsel for the petitioner as well as the Officer-in-charge it is expected by this Court that he would comply with the said order within time. As regards other relief i.e. with regard to payment of compensation is concerned, it being a disputed question as to for how much amount, in the facts and circumstances of the case petitioner would be entitled to claim from the respondent, this question cannot be gone into and adjudicated in this petition. That relief is left open. If the petitioner so desires and advised and also if permissible under the law, he is granted liberty to agitate the question with regard to compensation before the civil Court. The petition, therefore, stands finally disposed of but with no order as to costs.
