JUDGMENT 1. - Heard. 2. Learned counsel for the petitioner has submitted that the only evidence against the petitioner is the statement made by Bhoopsingh that out of the two persons, who were associated in the transportation of the illicit wine, one was the petitioner. There is no other evidence. Learned counsel has submitted that the above statement is not admissible in evidence. 3. In the facts and circumstances .of the case, the application under section 438 Cr.P.C. is allowed and it is hereby ordered that in the event of his arrest, the accused-petitioner may be enlarged on bail provided he furnishes a personal bond in the sum of Rs. 10,000 /- together with two sureties of Rs. 5,000 / - each to the satisfaction of the concerned investigating Officer on the following conditions:- (a) That he shall make himself available for interrogation by any Police Officer as and when required. (b) That he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts so as to dissuade him from disclosing such facts to the Court or to any Police Officer. Bail application allowed. *******
