JUDGMENT 1. - The learned Court below passed the strictures against the petitioner in para 33 of the judgment dated December 20, 1997 without affording any opportunity to the petitioner. 2. I am of the view that the said strictures could not have been passed in absence of the petitioner, who was not a party in the proceedings. 3. Resultantly the miscellaneous petition stands allowed and the following strictures passed in para 33 of the judgment dated December 20, 1997 by the Court below shall stand expunged.
