JUDGMENT 1. - Heard Mr. Rajpurohit for the appellant. 2. The appellant Insurance Company contended before the Tribunal that as the driver of the vehicle did not possess a proper licence to drive the vehicle, the Insurance Company was not liable to pay compensation. However, from para 9 of the award it is clear that no evidence was led on the point by the Insurance Company though the burden to prove that there was a breach of condition of the contract of insurance was on the Insurance Company. 3. In the aforesaid circumstances, the appeal has no force, it is dismissed.Appeal dismissed. *******
