Honble SINGH, J.–The petitioner is a Class IV employee working as a Sandesh Vahak. He claims to have passed a Prathma Examination conducted by Hindi Sahitaya Sammelan, Allahabad. The case of the petitioner is that Prathma Examination is equivalent to matriculation, he is entitled to be considered for promotion and the respondents are not considering him for promotion. He has, therefore filed this writ petition with a prayer that it should be declared that the petitioner is qualified for being considered for promotion and the respondents be directed to consider his case for promotion. (2). The petition has been contested by the respondents. Learned counsel for the respondents has submitted that Prathma Examination conducted by Hindi Sahi- taya Sammelan, Allahabad is treated as equivalent to matriculation for limited purposes and not for promotion to higher post. The respondents case is that the petitioner is not entitled to be considered for promotion as he does not possess requisite qualification prescribed under the Rules applicable to him. (3). The controversy appears to be fully covered by the decision given by a Division Bench of this Court in State Bank of India & Ors. V. Nand Ram (1). At page 66 of the judgment, it was observed: ``The Prathma Examination has been given only a conditional equivalence, i.e. for the Hindi Standard of the SSC/Matriculation only and not for full Matriculation and, therefore, it cannot be said that the pe- petitioner acquired the qualification of Matriculation or Secondary School Examination of SSC Examination. He does not fulfil the necessary educational qualification for promotion to the clerical cadre. As he lacks the requisite educational qualification therefore he was not eligible for promotion to the post of clerical cadre and his result was, therefore rightly with-held by the respondents-appellants. (4). The ratio propounded by the Division Bench in the above mentioned case is binding on this court, unless it is over ruled. The petitioners claim that the Prathma Examination conducted by Hindi Sahitaya Sammelan; Allahabad for con-sidering his promotion to the clerical cadre is ground less. (5). This petition has no force. It deserves to be dismissed and is hereby dismissed. In the facts and circumstances, no order as to costs.
