JUDGMENT 1. - This revision by the complainant has been directed against the order of acquittal dated 11 12.97 passed by the ACJM, Merta, whereby the acquitted the accused respondents of the offence under Section 147, 447, 427, 336 and 379 IPC. 2. Mr. Joshi contends that the trial court has erred in acquitting the accused disbelieving the testimony of the witnesses on the ground that they are interested witnesses. 3. I have gone through the judgment of the trial court as also the evidence recorded in the case. The independent witness has not supported the prosecution, case. It has come on record that there was already a suit pending with regard to the 'Bada'. 4. The trial court has considered the entire evidence and has come to the conclusion that it was not proved that the accused respondents had formed .unlawful assembly or had committed criminal trespass or had caused mischief. There is no cause to take a view different than the one taken by the learned Magistrate. It cannot be said that the conclusions arrived at by the trial court are wholly untenable or manifestly erroneous. 5. The revision petition is hereby dismissed.Revision Dismissed. *******
