Honble SHETHNA, J.–Learned counsel Shri Kalla submitted that out of 9 nine accused, 8 have been granted anticipatory bail by the learned Judge himself but he has denied anticipatory bail to the present petitioner accused Mukan Singh. He , therefore, submitted that this Court may grant anticipatory bail to the present applicant accused Mukan Singh. (2). From the order passed by the learned Sessions Judge, it clearly appears that the learned counsel for the petitioners almost conceded the case of the present accused Mukan Singh, by submitting that except Mukan Singh no specific role is attributed to any other accused, therefore, the learned Judge rejected bail petition of present accused Mukan Singh and granted bail to those accused against whom there was no specific allegations made for an offence punishable under Sec.3 of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act along with Sec. 323 and 341 IPC is registered. Hence, first submission made by Mr. Kalla has no substance. (3). Mr. Kalla then submitted that there was no intention of the accused to insult the complainant, therefore, he should have been granted anticipatory bail. Mr. Kalla has relied upon the judgment passed in State of Rajasthan vs. Kishore Singh (1). It was a State appeal against the order of acquittal. On fact of that case, after the evidence having been led before the Court, the trial Court acquitted the accused on the ground that there was no intention of the accused to insult the complainant. In this case, no evidence is led so far, therefore, whatever material is available before the Court, the same has to be taken into consideration as it is. Hence, the aforesaid judgment cited by learned counsel Shri Kalla will have no application in this bail petition filed by the accused. (4). At this stage, Mr. Kalla submitted that the accused will present himself before the Sessions Court with an application for bail. It is open to the accused to do so for that no direction from this Court is required. With these observations, this application is dismissed.
